Terms
Last updated: October 15, 2026
These terms are a contract between you and TONEY DIGITAL LLC, a Wyoming limited liability company, 30 N Gould St, Ste R, Sheridan, WY 82801, USA (“Tingly Room”, “we”, “us”). By using the site you agree to them and to our Privacy policy. If you don't agree, please don't use the site.
Please read section 18. Except for small-claims matters, disputes between you and us are resolved by binding individual arbitration, not in court, and you give up the right to a jury trial and to take part in a class action. You can opt out within 30 days of accepting these terms.
1. The service
Tingly Room helps you find public ASMR videos from YouTube, organised by trigger, mood and voice, and lets fans ask creators for custom videos (“requests”). Videos listed on the site stay on YouTube and belong to their creators; playing them is also subject to the YouTube Terms of Service. Tingly Room is not affiliated with, sponsored or endorsed by YouTube or Google.
Creator pages show public information from YouTube. A page doesn't mean the creator uses, endorses or works with Tingly Room, unless it shows that she joined (a verified page that takes requests).
ASMR videos are for relaxation and entertainment. Nothing on the site is medical, psychological or health advice or treatment.
2. Who can use Tingly Room
- The site is not meant for children under 13, and we don't knowingly collect their information.
- To create an account, send or take requests, pay or be paid, you must be at least 18 and of legal age to form a contract where you live (for example 19 in Alabama and Nebraska, 21 in Mississippi).
- You may not use the site if you are barred from doing so under the laws of the United States or of where you live, including sanctions laws.
3. Your account
- You sign in with a one-time code sent to your e-mail, with Google or Apple, or, for creators we invited, with a password we gave you. Keep them safe: you are responsible for what happens in your account. Tell us at once if you think someone else used it.
- One person per account. Give true information and keep it up to date. Don't impersonate anyone.
- Creators must prove that their YouTube channel is theirs, and pass the identity and bank checks of our payment partner before they are paid.
4. Content rules for requests, messages and videos
Custom videos are relaxing, non-sexual ASMR between adults. It is forbidden to ask for, offer, send or deliver:
- sexual or sexually suggestive content, fetish content, nudity;
- anything involving, depicting or sexualising a minor, or a person who looks like one;
- intimate images of anyone without their consent, real or digitally made (“deepfakes”);
- content about or imitating a real person other than yourself without their consent; hateful, harassing, violent, dangerous or illegal content;
- content that infringes someone else's copyright, trademark, privacy or publicity rights;
- contact details, social accounts, links to pay or meet outside Tingly Room.
To keep the platform safe, requests and messages are checked automatically and may be reviewed by our team. We may refuse, remove or block content, hold payments and suspend accounts that break these rules. We report apparent child sexual exploitation to the National Center for Missing & Exploited Children (NCMEC) and cooperate with law enforcement as the law requires.
5. Requests, prices and payment (fans)
- A creator answers your request with an offer: price (in US dollars), length and delivery time. You see the total before paying. Prices don't include sales tax today; if we become required to collect sales tax where you live, it will be shown and added before you pay.
- Payments are processed by Stripe. Your card details go to Stripe, not to us.
- Payment to Tingly Room is payment to the creator. Each creator appoints TONEY DIGITAL LLC as her limited agent to receive payments from fans for her. Once your payment succeeds, you owe nothing more to the creator for that offer, even if we haven't paid her yet.
- Payment protection. Your payment is collected for the creator and kept with our payment partner Stripe until you confirm you received the video, or until 3 days after delivery if you report no problem. The creator is paid then.
- Any extra request (a new idea, a longer video) is a new offer and a new payment.
6. Cancellations and refunds
- No delivery: if the creator declines after you paid, or doesn't deliver within the agreed time, you get a full refund.
- Not what was agreed: report a problem from the conversation before you confirm the delivery. The payment stays on hold while we review it; we may refund you in full or in part.
- After you confirm (or after 3 days without a reported problem), a custom video made for you can't be refunded, except where the law requires it.
- Refunds go back to the original payment method, usually within 5 to 10 business days depending on your bank.
- Please contact us before disputing a charge with your bank: most problems are solved faster this way. Abusive disputes can lead to the suspension of your account.
7. Creators
- You are an independent creator, not an employee, agent or partner of Tingly Room. You decide whether to accept a request, your price and how you make your videos, within these rules.
- We collect payments for you. You appoint TONEY DIGITAL LLC as your limited agent to receive fans' payments for your offers, through Stripe. A fan's successful payment counts as payment to you; we then pay you your share as described below.
- An offer the fan has paid for is a commitment: deliver what you offered, on time. Videos you deliver must be your own, lawful, and you must have the consent of every person who appears or is heard in them (all of them adults).
- Fee: when a request is completed you receive 85 % of the price; Tingly Room keeps 15 % as its service fee. We may change the fee for future offers with 30 days' notice.
- Payouts are made by our payment partner Stripe to the bank account you add in your wallet. Withdrawals are free for you; we may change this for the future with notice. By setting up payouts you agree to the Stripe Recipient Agreement (or the Stripe Connected Account Agreement where it applies), and to Stripe collecting the information needed to verify you and pay you.
- We may delay, hold or deduct amounts owed to you to cover refunds, chargebacks, fraud or a breach of these terms, and recover amounts paid to you by mistake.
- Taxes: you are responsible for your own taxes. We or Stripe may ask for your tax information (such as a W-9 or W-8BEN) and report your earnings to tax authorities as the law requires (for example on Form 1099).
- Licenses. You keep all rights in your videos. By delivering a video you give the fan a personal, non-commercial license to watch it for as long as they like; the fan may not publish, share, resell or use it to train AI. You give us the right to store, transmit, moderate and show the content you send through the site, and your profile, to run the service.
8. Reviews
After a request, the fan can rate the creator from 1 to 5 stars and write a review. Reviews must be honest, written by the fan, and about that request. We never pay for reviews or write them. Every rating counts in the creator's score; the written reviews shown on her page are the ones she chose to show. We may remove a review that breaks these rules.
9. Use of the site
Don't:
- scrape or copy the site or its data, or use automated means to access it, except search engines following our robots.txt;
- try to break, overload or get around its security, limits or moderation;
- create fake accounts, reviews or requests, or harass anyone;
- take payments or deals outside Tingly Room with someone you met here;
- use the site to get around the rules of YouTube or of Stripe, or for anything illegal.
10. Our rights
The site, its design, its classification of videos, its name and logo belong to us or our licensors. You may use the site for your own personal use only. If you send us ideas or feedback, we may use them freely.
11. Third-party services
Videos play in YouTube's player; payments and payouts run through Stripe; you may sign in with Google or Apple. Their own terms and privacy policies apply to what they do, and we are not responsible for them.
12. Copyright notices (DMCA)
We respect copyright and respond to notices under the Digital Millennium Copyright Act (17 U.S.C. § 512). If you believe material on Tingly Room infringes your copyright, send our Copyright Agent a notice through the contact form or to contact@tinglyroom.com, including:
- your physical or electronic signature;
- the copyrighted work you say is infringed;
- the material you say is infringing and where it is on the site (the link);
- your address, phone number and e-mail;
- a statement that you have a good-faith belief the use is not authorized by the owner, its agent or the law;
- a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act for the owner.
If your material was removed and you believe it was a mistake, you can send a counter-notice with the elements of 17 U.S.C. § 512(g)(3), including your consent to the jurisdiction of the federal court for your district (or, outside the US, any district where we may be found). We may restore the material 10 to 14 business days later unless the complainant tells us they filed a court action. We close the accounts of repeat infringers. Knowingly false notices can make you liable for damages.
13. Intimate images shared without consent
If an intimate image or video of you, real or digitally made, was published on Tingly Room without your consent, you (or someone authorized to act for you) can ask us to remove it through the contact form. Give us enough to find it, a statement that you have a good-faith belief it was published without consent, your contact details and your signature (your typed name). We remove it, and the identical copies we can find, within 48 hours of a valid request, as the TAKE IT DOWN Act requires.
14. Disclaimers
The site is provided “as is” and “as available”. To the extent the law allows, we disclaim all warranties, express or implied, including of merchantability, fitness for a particular purpose and non-infringement. We don't guarantee that the site will always be available or error-free, or that any video stays on YouTube. Custom videos are made by creators, not by us: we are not responsible for their content beyond what these terms and the law provide.
15. Limitation of liability
To the extent the law allows, Tingly Room and its members, managers and contractors are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or data, and our total liability for any claim about the site is limited to the greater of the amounts you paid us in the 12 months before the claim and US $100. Some states don't allow some of these limits, so they may not apply to you. Nothing in these terms limits liability that can't be limited by law, or your rights as a consumer under the law of the state where you live.
16. Your responsibility
You agree to defend and compensate us for claims by others, and the reasonable costs of them, caused by content you send or by your breach of these terms or of the law, to the extent the law allows.
17. Ending your use
You can stop using the site and ask us to delete your account at any time (contact form). We may suspend or close accounts that break these terms or the law, or to protect users. Payments on hold are then handled fairly: refunded to the fan or paid to the creator, depending on the case. Sections 6 to 8 and 12 to 20 continue to apply after an account is closed.
18. Disputes: informal resolution, arbitration and class action waiver
Talk to us first. Before starting a claim, write to us through the contact form with your name, your account e-mail, what happened and what you ask for. We will try to solve it within 60 days.
Arbitration. If we can't, you and we agree that any dispute about the site or these terms is resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, under the Federal Arbitration Act. The arbitration takes place by video or phone, or in the county where you live. For claims under US $10,000 we pay the AAA filing, administration and arbitrator fees beyond what you would pay to file in court. The arbitrator can award the same individual relief as a court.
Exceptions. Either of us may bring an individual claim in small-claims court, and either of us may ask a court to stop the infringement or misuse of intellectual property.
No class actions, no jury. Claims are brought only individually, not as a plaintiff or class member in a class, collective or representative proceeding, and you and we waive the right to a jury trial. If this class waiver is found unenforceable for a claim, that claim goes to court, not to arbitration.
Opting out. You can opt out of this section 18 by writing to us within 30 days after you first accept these terms, through the contact form or to contact@tinglyroom.com, with your name and account e-mail and a clear statement that you opt out of arbitration. Opting out doesn't affect anything else in these terms.
19. Governing law and courts
These terms are governed by the laws of the State of Wyoming and by the Federal Arbitration Act, without regard to conflict-of-law rules; consumer protection laws of the state where you live still apply to you where they must. Disputes that are not arbitrated go to the state or federal courts located in Wyoming, unless the law of your state gives you the right to sue where you live.
20. Changes and general terms
- We may update these terms. If a change is important, we tell you on the site or by e-mail at least 30 days before it applies to you; changes don't apply to disputes already started.
- These terms and the policies they mention are the whole agreement between you and us about the site. If a part is unenforceable, the rest stays in force. Not enforcing a part is not a waiver. You may not transfer these terms; we may transfer them with our business.
- We are not responsible for delays or failures caused by events beyond our reasonable control.
- We may send you notices by e-mail or on the site. These terms are written in English, which prevails over any translation.
21. Notices required by law
Parental controls. Parental control protections (such as computer hardware, software or filtering services) are commercially available and may help limit minors' access to material that is harmful to them. See the FTC's advice at consumer.ftc.gov.
California users. Under California Civil Code § 1789.3, you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by phone at (800) 952-5210.
